ORDER

This application is filed to grant leave to sue the respondent / defendant under Order III Rule 1 of the Original Side Rules, 1956 read with Clause 12 of the Letters Patent.

2. In a proposed suit for recovery of money in respect of freight 1/3

forwarding services provided by the intending plaintiff, leave is sought to SENTHILKUMAR RAMAMOORTHY,J rna sue the respondent before this Court. In the draft plaint, it is stated that material transactions relating to this suit, such as the issuance of invoices, took place at Chennai. Learned counsel also submits that all the transactions were enabled from the Branch Office of the plaintiff at Chennai.

3. Upon examining the draft plaint and the affidavit in support of this application, it appears that at least a part of the cause of action has arisen within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to sue the respondent before this Court.
