Respondents1 to 3 PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the third respondent to consider the petitioner's representation dated 10.12.2020 and reinstating him to the service or to pay subsistence allowances to him during the period of his suspension viz., 18.11.2016 to till date as per the procedures and pass such further or other orders. Mr.Sathish Kumar, learned Standing Counsel takes notice on behalf of the respondents. By consent, the Writ Petition is taken up for final disposal at the admission stage itself. 2.The third respondent passed an order dated 30.12.2017 exonerating the petitioner from all the charges framed against him. As per that order, the petitioner is entitled to be https://hcservices.ecourts.gov.in/hcservices/

reinstated in service. Even though he is entitled for reinstatement from the year 2017, it is submitted that he was not taken back to service. Aggrieved over the same, he made a representation dated 10.12.2020, to the respondents seeking for reinstatement and till such time, for subsistence allowance and the said representation is still pending before the third respondent.

3.Heard the submissions made by the learned counsel for the petitioner.

4.Considering the fact that the petitioner is without employment and he made a representation to the respondents, which is pending before the third respondent, without disposal for the past three years, a direction is given to the third respondent to consider the representation of the petitioner dated 10.12.2020 and pass orders, on merits and in accordance in law, within a period of four weeks from the date of receipt of a copy of this order.

5.The Writ Petition is disposed of accordingly. No costs.
