The applicant / plaintiff has filed this application seeking permission to mark the following documents as secondary evidence: Sl.No.

2. The learned counsel for the respondent submitted that these documents are not relevant to the present case and the supply of goods itself was denied by the defendants in their written statement. It is further submitted that the plaintiff is not entitled to mark any photocopies of the documents and hence the application should be dismissed.

3. The learned counsel for the applicant submitted that these documents have been sent by the defendant himself and the originals of which are not available with him now.

4. Since the applicant has submitted that the originals are lost, he has

no other option except to produce the copies of the same. Hence I feel that, in the interest of justice, this application can be allowed

5. Accordingly, this application is allowed.
