Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 4(1)(a), 4(1)(h) of Tamil Nadu Prohibition Act, in Crime No.65 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The petitioner herein as a named accused in crime No.65 of 2022 registered under Section 4(1)(a), 4(1)(h) of Tamil Nadu Prohibition Act, by the respondent police. On 28.03.2022 as per FIR, when the respondent was on regular patrol near Thirupathur, Ashok Nagar Railway Line, on seeing police, a person fleeded from the spot and abandoning 381 liquor packets belongs to karnataka region. Later, police investigation reveals that person who fleeded from the scene of occurrence, abandoning of liquor packets was one V.Vijayakumar is before this Court seeking anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/
3. The learned counsel for the petitioner submits that the petitioner is an innocent person.
4. However, this Court from the FIR finds that the police has seized 384 number of illicit liquor packets and their investigation has indicated that this petitioner is the named accused in this case. Though it is contended that the petitioner is a M.Sc.student and he has no role in the said offence and and he is not connected with the seized liquor packets, the plea of anticipatory bail could not be entertained.
4. Taking note of the above fact and the quantum of contraband seized and the petitioner pleaded from the scene of occurrence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal original petition is dismissed.
