ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 18.12.2020 for the alleged offences punishable under Sections 457 and 380 of I.P.C, in Crime No.850 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner broke open the door of the defacto complainant's house and stolen a sum of Rs.18,250/-. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor submits that the petitioner broke open the door of the defacto complainant's house and stolen a sum of Rs.18,250/-. She further submits that the petitioner is a habitual offender. However, he vehemently opposed for grant of bail to the petitioner.

5.Considering the facts of the case and the submission made by the additional public prosecutor that the petitioner is habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
