Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the respondent police to register petitioner's complaint dated 25.01.2018 in CSR No.45/2018 given against the Sub Registrar, Thirukazhukundram, under appropriate provisions of Criminal law, conduct investigation and to proceed in accordance with law.

ORDER

This Criminal Original petition is filed for seeking direction to the respondent police to register the complaint dated 25.01.2018 in CSR No.45/2018 against the Sub Registrar, Thirukazhukundram.

The learned Additional Public Prosecutor would submit that the petitioner herein has presented documents to register the property, which is shown as burial ground as per the record maintained by the Sub Registrar. Whereas, the contention of the petitioner is that Survey No.9/5 is a grama natham.

In the course of the dispute, there had been wordy quarrel between the petitioner and Sub Registrar. Which has led to the registration of the complaint by the petitioner herein against the Sub Registrar.

The learned Additional Public Prosecutor submits that the Sub Registrar of Thirukazhukundram lodged counter complaint against this petitioner and the same has been registered in CSR.44 of 2018, dated 25.01.2018. Since, there is a complaint and counter complaint it is, suffice to direct the respondent police to complete the enquiry and proceed in accordance with law, within a period of https://hcservices.ecourts.gov.in/hcservices/

30 days from the date of receipt of copy of this order. The petitioner herein, shall appear before the respondent police on 23.03.2018 and place all the materials available with him and also co-operate with the enquiry. The respondent police is directed to furnish the copy of the complaint given by the Sub Registrar to the petitioner herein to meet out the complaint against him.

With the above direction, this Criminal Original petition stands disposed of.
