ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 08.12.2020 for the alleged offences punishable under Sections 457 and 380 of I.P.C in Crime No.1671 of 2020, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner committed theft of 18 soverigns of gold from the house of the defacto complainant. Hence, the complaint.
3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor submits that the petitioner committed theft of 18 soverigns of gold. He further submits that the petitioner is a habitual offender and there are seven previous cases pending against the petitioner. 5.Considering the fact that the petitioner is a habitual offender and there are seven previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
