Writ Appeal filed under Clause 15 of the Letters Patent praying to set aside the order passed in WP No.1093 of 2018 dated 26.09.2022 by allowing the Writ Appeal.

Mr.M.Ilansezhiyan for R1 Ms.S.Sindhuza for Mr.L.Jai Venkatesh, Standing Counsel for R2 to R4 Judgment (Judgment of the Court was delivered by S.M.Subramaniam J.) The writ order dated 26.09.2022 passed in W.P.No.1093 of 2018 is under challenge in the present Writ Appeal.

2. The respondents 4 to 7 in the Writ Petition are the appellant before this Court. The 1st respondent submitted an application seeking shifting of Low Tension line and the said application since not considered, the Writ Petition came to be instituted.

3. The learned Single Judge considered the issues and passed a direction to the respondents/ TANGEDCO, which reads as follows: ● That there shall be a direction to the respondent TANGEDCO to verify the spot and prepare a feasibility report to draw alternative line avoiding the line already drawn across the land belonging to the petitioner and if it is possible, a feasibility report along with the estimate for drawal of

alternative line can be supplied by the TANGEDCO to the petitioner and on receipt of the same, it is open to the petitioner to come forward for making payment of such expenses to be incurred by the TANGEDCO.

● In that case, if the expenses being deposited by the petitioner, the respondent TANGEDCO can made further arrangements to draw the line in the alternative route as per the feasibility report to continue the supply to the lands of the private respondents.

● The needful as indicated above shall be undertaken with the cooperation of the petitioner within a period of two months from the date of receipt of a copy of this order.

4. In pursuance to the direction issued by the writ Court, TANGEDCO conducted field inspection and a status report has been filed by the Assistant Engineer, TANGEDCO before this Court. Paragraph No.6 of the status report reads as under :

6. I humbly submit that since the LT line extension would be extended across the lands of the Appellants herein, the 1st respondent/ writ petitioner herein should obtain No Objection Certificate (NOC) from the Appellants herein. I humbly submit that on filing of online application for shifting and after payment of necessary shifting charges, the respondents would take necessary steps for shifting of LT line in the alternative route.

5. The TANGEDCO Authorities found that shifting of Low Tension line in the alternative route is feasible and the 1st respondent has to pay the necessary charges and secure No Objection Certificate from the appellants.

In view of the said status report, no further adjudication needs to be undertaken. It is for the parties to approach the Authorities to workout their remedy mutually.
