O R D E R

The petitioner has come forward with this revision challenging the order passed by the Principal Sessions Judge, Vellore, whereby the Court below directed the petitioner to deposit 1/4th of the cheque amount, amounting to Rs.90,000/-, as a condition for grant of stay of the order of the lower Court.

2. Though notice was sent to the respondent and his name is shown in the cause list, there is no appearance for the respondent.

3. The learned counsel for the petitioner submitted that the order of the Court below to deposit 1/4th of the cheque amount is bad in law since no such order could be passed. However, the learned counsel volunteers to deposit Rs.35,000/- to show his bonafides and prays for time for such deposit.

4. Considering the submissions made on behalf of the petitioner, this Court is inclined to modify the order passed by the Court below. Accordingly, the petitioner is directed to deposit a sum of Rs.35,000/- (Rupees Thirty Five Thousand only), which the petitioner is also willing, within a period of two weeks from the date of receipt of a copy of this order, failing which the stay granted will get automatically vacated.

5. The revision is disposed of accordingly. Consequently, M.P.No.1/2015 is closed.
