(Order of the Court was made by R.SUBRAMANIAN, J.) Since the Appeal was dismissed without service of notice on the eleventh respondent, this petition has been filed seeking to condone the delay for restoration of the Appeal that was dismissed for default as against the eleventh respondent. We see no necessity to issue notice in this petition inasmuch as the notice in the Appeal was not served on the eleventh respondent.

2. Accepting the averments made in the affidavit filed in support of the petition, the delay is condoned.

3. The Registry is directed to number the restoration petition and post it on 12.11.2024.
