Respondents Petition under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, to direct the respondents to consider the representation of the petitioner, dated 18.08.2018, for transfer from Chennai District to Kancheepuram District within a reasonable time. ORDER

This Writ Petition has been filed for issuance of a writ of mandamus, directing the respondents to consider the representation made by the petitioner on 18.08.2018, through which, she sought for re-transfer from Chennai District to Kancheepuram District.

2. The case of the petitioner is that she entered into the service of Revenue Department in the year 2008 as a Village Administrative Officer (VAO) and, thereafter, she was appointed as an Assistant by direct recruitment and posted in Kancheepuram District. Subsequently, she got promotion as Deputy Tahsildar and, thereafter, as Tahsildar in the very same district. In the year 2018, the first respondent issued a Government Order vide G.O.Ms.No.1, dated 04.01.2018, wherein, certain revenue villages from Kancheepuram District and Tiruvallur District were added to Chennai Revenue District and, thereby, the Corporation limit of Greater Chennai was expanded. In so far as Kancheepuram Disitrict is concerned, as many as 35 villages were included in Chennai Revenue District.

3. After passing of the above Government Order, the petitioner was posted to serve as Settlement Tahsildar (Town Survey) (UDR) at Alandur.

The petitioner was also asked for her willingness to get herself transferred to Chennai District and the petitioner expressed her unwillingness, by her letter, dated 27.06.2018, to get herself transferred, by citing personal problems. However, the said letter was not accepted and the petitioner was transferred to Chennai District.

5. The grievance of the petitioner is that some of the Tahsildars, who are juniors to her, have been retained at Kancheepuram. Ultimately, the petitioner was relieved from Kancheepuram District on 28.01.2019. In the meantime, the petitioner had given a representation, dated 18.08.2018, to the second respondent, making a request for retransferring her to Kancheepuram District. The said representation was also not considered and, therefore, the petitioner now wants it to be considered and also makes a request transfer to transfer her to Kancheepuram District, citing personal problems.

6. Heard Mr.K.Venkatramani, learned Senior Counsel, appearing for the petitioner; and Mr.P.S.Sivashanmugasundaram, learned Special Government Pleader, for the respondents.

Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this Writ Petition, there shall be a direction to the second respondent to consider the representation made by the petitioner on 18.08.2018 and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

8. The petitioner is directed to make a fresh representation to the second respondent along with a copy of the representation, dated 18.08.2018, and also a copy of this order.

9. With the above directions, this Writ Petition is disposed of. No costs.
