In the judgment rendered in appeal affirming the order of the learned Single Judge, no directions were passed for the backwages to be treated as spread over a number of years which could have facilitated some benefit of income-tax. The judgment was rendered on 06.09.2006 and the amount was paid on 30.08.2007 soon whereafter the present application was filed in September, 2007. However, this application has not been got listed for more than seven years during which time the assessments would have been completed.
2.We are, thus, of the view that on account of the appellant not following up the issue and there being gross delay and laches in getting the application listed, as also by reason of the fact that there is no specific order passed by the Division Bench while disposing of the appeal, this is not a fit case for interference.
3.Miscellaneous Petition, thus, stands dismissed. [CJ] 06/07/2016
