The plaintiff in a suit, seeking partition was rejected under Order 7 Rule 11 of C.P.C., is on appeal. He seeks an order of injunction restraining the defendants from alienating the property.

2.It is made clear that any alienation will be subject to result of the appeal, in view of Section 52 of the Transfer of Property Act. Hence, we see no reason to grant of injunction. This injunction petition is therefore, dismissed.
