O R D E R

This petition has been filed to direct the respondent to register an FIR on the petitioner's complaint dated 15.04.2016.

2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. When the matter was taken up for hearing, learned Additional Public Prosecutor on instructions submitted that, the respondent Police have registered a case in Crime No.177 of 2016 under Section 174 Cr.P.C. on the complaint given by one Saraswathi, W/o.Pushparaj, in connection with the death of Pushparaj in Chengalpet Medical College.

4. Learned Additional Public Prosecutor also submitted that since the petitioner and others had abused the Doctors who had treated the deceased Pushparaj, a case in Crime No.175 of 2016 has been registered on the complaint of Dr.Arulselvam, for offences under Section 294[b], 353 IPC r/w Section 3 of Tamil Nadu Medicare Service Persons and Medicare Service Institution Prevention of Violence and Damage or Loss to Property Act, 2008. On the complaint given by the petitioner, petition enquiry is pending in CSR.No.191 of 2016. https://hcservices.ecourts.gov.in/hcservices/

5. It is the allegation of the petitioner that his brother Pushparaj was not given proper treatment by the Doctors in Chengalpet Medical College. Since already a case in Crime No.177 of 2016 has been registered, it is not necessary to register a fresh case in CSR.No.191 of 2016. Hence, this petition is closed.
