ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 2(e)(vi) of Motor Spirit & High Speed Diesel) PMSD Order 1998 r/w.7(i), (a) (ii) of Essential Commodities Act 1995 in Crime No.42 of 2020, on the file of the respondent police, seeks anticipatory bail.
2. It is the case of the prosecution that the petitioner is alleged to have indulged in selling diesel illegally without proper permission and licence, to private persons in retail outlet in a mini tanker lorry. The petitioner is the owner of the lorry.
3. Learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. Learned Additional Public Prosecutor submitted that the petitioner is implicated in this case based on the confession of A1. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5.Taking note of the facts and circumstances of the case and the gravity of the offence alleged against the petitioner and the petitioner is alleged to have indulged in selling of essential commodity illegally, this Court is not inclined to grant anticipatory bail to the petitioner. Hence this petition is dismissed.
