ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2), 326(a) of BNS in Crime No.663 of 2026 on the file of the respondent

police seeks anticipatory bail.

2. The allegations against the petitioner are that on 23.12.2025, the petitioner illegally transported 3 units of gravel sand in a tipper lorry bearing Registration No. TN 15 MC 4524 without any valid permission. On seeing the de facto complainant, the petitioner escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that 3 units of sand had been illegally extracted from the river and opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter, the petitioner has two previous cases of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
