PRAYER: The Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, pleased to direct the Hon'ble Additional Sub Court, Salem to recall the Non-Bailable warrant issued as against the petitioners herein in S.C.No.163 of 2016. For Petitioners : Mr.W.Camyles Gandhi For Respondent : Mr.A.Gokulakrishnan Additional Public Prosecutor.

O R D E R

This Criminal Original Petition has been filed seeking to direct the learned II Additional Sub Court, Salem to recall the Non-Bailable warrant issued as against the petitioners herein in S.C.No.163 of 2016.

2. It it submitted by the learned counsel for the petitioner that the Non-Bailable Warrant is pending against the petitioners 1 and 2 from 17.10.2019 and against the 3rd petitioner from 12.10.2017. It appears that the respondent police has also not taken any steps to execute warrant. However, the petitioners approached directly this Court without approaching the trial https://hcservices.ecourts.gov.in/hcservices/

Court concerned for recalling the warrant, cannot be appreciated.

3. This Court directs the petitioner to approach the learned Judge concerned with appropriate petition for recalling warrant. On filing such petition, learned Judge is directed to dispose the petition on merits in accordance with law on the same day.
