O R D E R
The petitioner apprehends arrest for the alleged offence under Sections 64(2), 64(2)(f), 64(2)(l), 64(2)(m) of BNS Act, in Crime No.3 of 2026 on the file of the respondent police seeks anticipatory bail. 1/4
2. The allegation against the petitioner is that he committed sexual assault on the victim girl aged about 20 years and subsequently, she became pregnant. Hence, a complaint has been registered against the petitioner.
3. The learned Government Advocate (Crl.Side) appearing for the respondent stoutly opposed the grant of anticipatory bail to the petitioner on the ground that A2 and A1 were living separately and the victim is the daughter of A2. He further submitted that with the assistance of the second accused, the accused had committed the offence of rape.
4. From the submissions made by the learned Government Advocate (Crl.Side) it comes to the knowledge of this Court, that the victim is aged about 20 years and further DNA report is yet to be received. In such circumstances and also considering the gravity of offence, this Court is not inclined to enlarge the petitioner on anticipatory bail.
5. Accordingly, this Criminal Original Petition is dismissed. 04.03.2026 DRL 2/4
