The petitioner seeks bail in Crime No.63 of 2024, registered by the respondent police for the offences punishable under Sections 120(b) of I.P.C, 17, 5(l) 5(i) 5(ii) r/w 6 of POCSO Act,2016. The petitioner had been taken into custody on 05.02.2024.
2.It is stated that this petitioner along with other accused had forced the victim child to indulge in prostitution. The child had also became pregnant. Thereafter, a complaint was given before Child Welfare Committee. In the counter affidavit it had been very specifically stated that several persons had committed penetrative sexual assault on the victim girl who is a minor. The victim girl requires care and protection.
3. The specific overt act as against this petitioner is that she was directly involved in luring the victim girl to prostitution and had provided a place for such illegal activity.
4. Considering the nature of offence committed by the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 26.03.2024 smn
