ORDER

This Criminal Original Petition has been filed seeking to quash the proceedings in SC.61/2021 pending on the file of the III Additional District and Session Court, Coimbatore.

Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the first respondent Police submitted that this court, in Crl.O.P.No. 26896 of 2016, has already quashed the proceedings in S.C.No.61 of 2021 as against accused 1 to 3 vide order dated 20.06.2017.

Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition stands closed. Consequently, connected miscellaneous petitions are closed. 18-12-2025 Index: Yes/No Speaking/Non-speaking order RPP To

ORDER

This criminal original petition was closed by this Court on 18.12.2025 by considering that the case qua other accused has already been quashed by this Court. For the sake of ready reference, the order dated 18.12.2025 is reproduced below:

"The Criminal Original Petition has been filed seeking to quash the proceedings in SC No.61/2021 pending on the file of the III Additional District and Session Court, Coimbatore. 2.

Today, when the matter was taken up for hearing, the learned Addl. Public Prosecutor appearing for the first respondent Police submitted that this Court, in Crl.O.P. No.26896 of 2016, has already quashed the proceedings in S.C.No.61 of 2021 as against accused 1 to 3 vide order dated 20.06.2017.

Recording the submission made by the learned Addl. Public Prosecutor, this Criminal Original Petition stands closed. Consequently, connected miscellaneous petitions are closed." 2.

According to the learned counsel for the petitioners, the aforesaid order does not state that the proceedings in S.C. No.61 of 2021 against the petitioners, who are AA 4 and 5, stands quashed and hence, appropriate change may be made in the aforesaid order. 3.

It is for the aforementioned reason that this matter is listed today under the caption "FOR BEING MENTIONED". 5/9

Be that as it may, when this Court perused the order dated 20.06.2017 passed in Crl.O.P. No.26896 of 2016 in and by which the case against AA 1 to 3 was quashed and they were acquitted, it came to light that their case was pending trial in C.C. No.6 of 2016, whereas, the petitioners are facing trial in S.C. No.61 of 2021.

When asked to clarify the position, the learned Government Advocate (Crl. Side) submitted that the case against AA 1 to 3 was in PRC stage and subsequently, it was committed to the Court of Session and was taken up on file by the III Additional District and Sessions Court, Coimbatore, as S.C.No.61 of 2021.

Thus, it becomes clear that the case against AA 1 to 3 was only P.R.C. No.6 of 2016 and not C.C. No.6 of 2016 as found in the order dated 20.06.2017 and the query raised by this Court stands clarified. 7.

Further, acceding to the submission made by the learned counsel for the petitioners, the order dated 18.12.2025 passed in this case shall stand substituted as under:

"This criminal original petition has been filed seeking to quash the proceedings in S.C. No.61/2021 pending on the file of the III Additional District and Session Court, Coimbatore.

Today, when the matter was taken up for hearing, it was brought to the notice of this Court that the case against AA 1 to 3 has already been quashed by this Court in Crl.O.P. No.26896 of 2016 vide order dated 20.06.2017 based on the memorandum of understanding dated 21.08.2015 entered into by AA 1 to 3 and the de facto complainant. 3.

When admittedly the case against AA 1 to 3 has been quashed by this Court, this Court is of the opinion that no useful purpose would be served by keeping the impugned proceedings against the petitioners, who are similarly placed, pending. 4.

Accordingly, the impugned proceedings against the petitioners in S.C. 61 of 2021 on the file of the III Additional District and Sessions Court, stands quashed.

In the result, this criminal original petition stands allowed. Connected miscellaneous petitions are closed." 8.
