(CRIME NO.33 OF 2022) For Petitioner : NO APPEARANCE For Respondent : MR.S.SANTHOSH, Govt. Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under sections 6(4) of TNSC (RDCS) Order 1982 r/w. 7(1)(a)(ii) of E.C.Act, 1955 in Crime No.33 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that 1050 kgs of PDS rice packed in 21 bags in an unregistered TVS XL Super was seized by the respondent police.

3. The learned Counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he pleads for grant of anticipatory bail to the petitioner.

4. The investigation reveals that, it was a petitioner who collected the PDS rice and on seeing the raiding party, he had fled from the scene of crime at the point of seizure and abandoned the vehicle along with the PDS rice.

5. In view of the fact that the petitioner's earlier anticipatory bail petition was dismissed on 29.03.2022, since there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
