By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.
2. This writ petition has been filed seeking a Writ of Mandamus, to direct the respondents to include the names of the petitioner in the panel drawn for promotion to the post of Forester on par with their junior, with all consequential service and monetary benefits.
3. According to the petitioners, the petitioners herein are working as Forest Guards in the respondent department. The 2nd respondent in his Proceedings No.AB2/42753/2020 dated 07.05.2021, the service of the petitioners as Forest Guard was notionally included in the panel for promotion in the year 2004 and their seniority number in the post of Forest Guard was assigned as 139(B)(1) and 181(A2A5)1 respectively and the seniority was assigned above their junior namely K.Arunachalam and G.Venkatachalam. The aforesaid revised seniority list was published in the order dated 07.05.2021. Based on the aforesaid revised seniority list, the petitioners made representations to the respondents to include their name in the next panel for promotion to the post of Forest Officer. Further, the petitioners are likely to be retired from service within one year and the said representations are still pending, no order has been passed. Hence, they filed this instant writ petition before this Court.
4. The learned Additional Government Pleader takes notice for the respondents would submit that the representations of the petitioners will be considered by the authorities concerned on merits and in accordance with law, within a time frame as fixed by this court.
5. Inview of the above submissions and also considering the limited scope of prayer, without expressing any opinion on merits, this Court is inclined direct the 2nd respondent to consider the petitioners representation dated 14.05.2021 and 20.10.2021 and pass appropriate orders on its own merits, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
6. With the above direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
