ORDER

This Criminal Revision Case has been filed by the petitioner to set aside the order dated 28.11.2022 made in M.C.No.14 of 2019 on the file of Family Court, Villupuram.

2. Heard the learned counsel for the petitioner/wife and perused the materials available on record.

3. Since the revision is pending from the year 2023 and no adverse order is being passed against the respondent, no fresh notice is ordered to the respondent/husband.

4. It is seen from the records that the petitioner/wife filed a maintenance case against her husband/respondent herein in M.C. No.14/2019 before the Family Court, Villupuram. The said petition was dismissed by the Magistrate by order dated 28.11.2022 on the ground that the respondent is unemployed and he is not a man of means and after an accident, the respondent suffered disability and receiving a sum of Rs.400/- towards pension for physically challenged persons and that the petitioner is employed in a private company and earning salary of Rs.3,000/- per month.

5. The petitioner is not able to substantiate any material to show that the petitioner has no means to maintain herself and the respondent is a man of 2/4

means and despite the same, the respondent neglected to maintain the petitioner. In the absence of the same, this Court as a revision Court, does not find any reason to interfere with the order of the Magistrate and there is no perversity in the order passed by the Magistrate.

6. Accordingly, this Criminal Revision Case is dismissed. 10.03.2025 Index : Yes / No Speaking Order : Yes / No ksa-2 To The Family Court, Villupuram.
