Respondents This Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus, calling for all the records of the second respondent pertaining to proceeding in Rc.No.Y4/13100/2015 dated 24.4.2015 and quash the same and consequently direct the respondents to reinstate the petitioner into service with all benefits.

O R D E R

The order of suspension of the second respondent dated 24.4.2015 is under challenge in this writ petition.

2. The writ petitioner was working as Deputy Inspector of Survey and Land Records at Vaniyambadi Taluk Office, Vellore District. An order of suspension was issued on the ground that the report has been received from the Vigilance and Anti-Corruption Department against the writ https://hcservices.ecourts.gov.in/hcservices/

petitioner and based on that, the writ petitioner was placed under suspension. Subsequently, a charge memo was also issued against the writ petitioner in proceedings dated 14.5.2015.

3. The learned counsel appearing for the writ petitioner states that though the writ petitioner was placed under suspension on the basis of the report submitted by the Department of Vigilance and Anti-Corruption, he was not arrayed as an accused in the criminal case. However, it is left open to the writ petitioner to submit his explanations/objections to the Competent Authorities and prove his innocence.

4. This Court, in this writ proceedings, cannot decide the merits of the case at this stage. Intermittent interference in the disciplinary proceedings are not preferable and the facts and circumstances and the evidences are to be considered by the Competent Authorities at the time of taking departmental domestic enquiry.

5. In this view of the matter, the order impugned in this writ petition is in order and there is no infirmity. Thus, the writ petition is devoid of merits. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed.
