With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
2. This writ petition is filed to restore the patta in the name of the petitioner which was issued to the petitioner vide proceedings dated 16.05.1996 in F2 No.586:96 in respect of Survey 105 ID Survey No.226/2 Plot measuring 0.7222 sq.ft. Alandur.
3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the first and second respondents and perused the materials available on record.
4. The case of the petitioner is that the third respondent filed a suit for permanent injunction and the suit has been dismissed. An appeal has been filed and the lower appellate court allowed the appeal as against which the second appeal filed by the petitioner has been allowed and the said order attained finality. The grievance of the petitioner is that he has made a representation to the second respondent subsequent to the judgment in the second appeal to restore the patta in the name of the petitioner. But the same 2/4
has not been considered by the second respondent. Hence, the present Writ Petition.
5. Considering the limited relief sought for in this Writ Petition, the second respondent is directed to consider the representation of the petitioner dated 07.03.2022 within a period of two months from the date of receipt of a copy of this Order.
