The prayer sought for in the present petition is to direct the respondents to return the driving license no. TN51 w 1998 0002526 dated 16.12.1998

2. Heard both sides.

3. Today, when the matter is called, the learned Additional Public Prosecutor had handed over the original driving license no. TN51 w 1998 0002526 dated 16.12.1998 to the learned counsel for the petitioner. It is needless to mention that, it is open to the respondent to proceed against the petitioner by way of Departmental Proceedings. This Court is of the view that the action of seizing the driving license, which is a prime document for the petitioner's occupation, is improper. https://hcservices.ecourts.gov.in/hcservices/

Since the respondent has right to proceed against the petitioner by initiating the departmental proceedings or any other action as contemplated under the law, this criminal original petition is disposed of with a direction to the petitioner herein to co-operate with the respondent during the course of the such enquiry.
