This writ petition has been filed seeking issuance of Writ of Mandamus directing the Tahsildar to collect the penalty amount which was mentioned in District Collector's proceedings dated 20.04.2016 in R.C.No.122/2016.
2.The learned counsel appearing for the petitioner submitted that the petitioner made complaint before the first respondent seeking to take necessary action against the lease holders of rough stone quarries granted in SF.No.71/1 of Appukal Village, Vellore Taluk for quarrying stones illegally in adjoining non-permitted areas to the first respondent and the first respondent vide proceedings dated 20.04.2016 informed the petitioner that prompt action has been taken to levy penalty to the offenders for illicit removal of rough stone in non-permitted area and that action is being taken by the Tahsildar concerned to collect the penalty amount under Tamil Nadu Revenue Recovery Act, 1890, however, the said order was not implemented. Hence, this Court may issue direction to the third respondent to implement the order of the first respondent.
3.Considering the limited request now made by the learned 2/4
counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the third respondent to implement the order of the first respondent in proceedings dated 20.04.2016 in R.C.No.122/2016, after providing opportunity to the lease holders of rough stone quarries, if there is no legal impediment, within a period of twelve weeks from the date of receipt of a copy of this order.
