ORDER

The petitioner has filed WP No. 14862 of 2016 before this Court praying to issue a Writ of Mandamus directing the second respondent in the writ petition, who is the respondent in this contempt petition, to dispose of his representation dated 19.09.2015 and to issue legal heir certificate within a time frame.

When the above writ petition was taken up for hearing on 22.04.2016, this Court disposed of the writ petition by directing the respondent herein to consider the representation dated 19.02.2015 of the petitioner for issuance of legal heir certificate and to pass orders thereon within a period of six weeks from the date of receipt of a copy of the order. According to the petitioner, the respondent did not comply with the said order dated 22.04.2016 passed by this Court and therefore, he has filed this contempt petition. 3.

Today, when the contempt petition is taken up for hearing, the learned Government Advocate appearing for the respondent produced a copy of the proceedings bearing Proc.No.A6/03634/2016 dated 14.10.2016 passed by the Tahsildar, Tondiarpet Taluk whereby the claim of the petitioner for issuance of legal heir certificate was rejected. A copy of the proceedings dated 14.10.2016 was also issued to the counsel for the petitioner. By relying on the proceedings dated 14.10.2016, the learned Government Advocate would contend that the order passed by this Court has been complied with by the respondent.

Having regard to the fact that pursuant to the direction issued by this Court on 22.04.2016 in WP No. 14862 of 2016, the respondent has passed an order dated 14.10.2016 rejecting the claim of the petitioner, this Court is of the view that there is nothing survives for adjudication in this

contempt petition. It is open to the petitioner to challenge the proceedings dated 14.10.2016 of the Tahsildar, Tondiarpet Taluk, Chennai - 600 081 in a manner known to law.
