C.M.P.No.15365 of 2016 in C.M.A. No.SR100252 of 2015 T.RAJA, J.

Aggrieved by the impugned award dated 09.12.2014 made in M.C.O.P. No.4612 of 2011 on the file of the Motor Accidents Claims Tribunal, (V Small Causes Court), Chennai, awarding a sum of Rs.1,07,500/-, the claimant/ petitioner has proposed to file the appeal seeking enhancement of the compensation. In the meanwhile, there was a delay of 243 days in filing C.M.A. No.SR100252 of 2015.

2.The reasons adduced to condone the delay shows that with a delay of about 27 days, the certified copies were made ready i.e. on 12.02.2015. Except the reason that the claimant was in need of money and due to the same, he could not file the appeal within the reasonable time, no proper explanation has been given for condoning the delay. 3.As it is well settled law that everyday's delay has to be explained and no such explanation has been given in the present case, this petition fails and the same is dismissed. Consequently, CMA No.SR100252 of 2015 stands rejected.
