W.M.P.No.8125 of 2024 in Writ Petition No.1868 of 2024 W.M.P.No.8125 of 2024 in Writ Petition No.1868 of 2024 N.ANAND VENKATESH , J This miscellaneous petition has been filed to recall the order passed by this Court in W.P.No.1868 of 2024, dated 30.01.2024 on the ground that the petitioner in the main writ petition had concealed certain vital facts in this case and obtained the order in W.P.No.1868 of 2024.

2. Learned Additional Public Prosecutor, on instructions, submitted that this Court directed the writ petitioner to submit a fresh representation/complaint to the second respondent police and thereafter, directed the second respondent police to conduct an enquiry by calling all the parties concerned. However, till date, no fresh complaint/representation has been received from the writ petitioner.

3. In the considered view of this Court, as and when fresh representation/complaint is given by the writ petitioner to the second 1/2 https://www.mhc.tn.gov.in/judis

W.M.P.No.8125 of 2024 in Writ Petition No.1868 of 2024 N.ANAND VENKATESH, J respondent police, the second respondent police shall call the parties for enquiry and at that time, it is left open to the petitioners in the recall petition to submit all the relevant documents pertaining to the earlier complaints given and closure of the same. The same will be considered by the respondent police at the time of enquiry. It is made clear that the order passed in the writ petition does not give any fresh cause of action and the second respondent will consider the case based on the materials that are furnished by the respective parties. This observation will sufficiently take care of the apprehension raised by the petitioners in this petition.
