ORDER

The petitioners, who were arrested and remanded to judicial custody on 10.01.2026 for the alleged offence under Section 140 (2) BNS @ 140 (2), 191, 192, 204 BNS in Crime No.16 of 2026 on the file of the respondent Police, seek bail.

2.The case of the prosecution is that the petitioners kidnapped the defacto-complainant and demanded money from him. Hence, the case.

3. The learned counsel for the petitioners would submit that the very the narration of the prosecution case is far from the fact according to the prosecution the alleged kidnapping had taken place only to snatch Rs.1300/-. The petitioners had been in custody since 10.01.2026. He also submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court and undertakes not to tamper with the witnesses. Hence, he prayed for grant of bail.

4.Though the said contention appears to be in order, the submission of the learned Government Advocate (Criminal Side) that these accused have got pending cases. The first accused has got four previous cases, the second accused has got three previous cases and the third accused has got one previous case. In such view of the position, and also considering the nature of allegations, this Court is of the view that, it is not desirable to enlarge the petitioners at this point of time, as there is every possibility to tamper the witness. Accordingly, this Criminal Original petition is dismissed.
