Vs 1 TAMILARASI [ RESPONDENTS ] 2 KALAIVANI 3 VADIVUKKARASI 4 KOKILAVANI 5 RAMATHILAGAM 6 ARUIRSELVI 7 SENTHIL KUMAR Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay all further proceedings pursuant to the judgement and decree passed in MCOP.103/2016, dated 08-11-2018, on the file of the MACT( Prl.District Court) Perambalur, pending CMA No1981 of 2019.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.T.RAVICHANDRAN, Advocate for the petitioner and of MR.C.SIVAKUMAR Advocate (Caveator) for the respondent 1 to 6 the court made the following order:-
(Order of the Court was made by M.M.SUNDRESH, J.) Mr.C.Sivakumar, learned counsel takes notice for the caveators/respondents 1 to 6.
2.There shall be an order of interim stay on condition that the petitioner/insurance company deposits 50% of the compensation awarded by the Tribunal along with proportionate interest to the credit of M.C.O.P.No.103 of 2016 on the file of the Motor Accidents Claims Tribunal (Principal District Judge), Perambalur, within a period of six weeks from the date of receipt of a copy of this order.
3.On such deposit, the claimants/respondents 1 to 6 are permitted to withdraw 50% of their respective shares along with accrued interest. This miscellaneous petition is disposed of accordingly.
