This petition is filed under Section 17 B of the Industrial Disputes Act. 1947, seeking last drawn wages. As per the orders passed in I.D.No.791 of 2018, dated 29.09.2022 the respondent was directed to reinstate the petitioner, however, the respondent has not reinstated the petitioner. The petitioner has filed an affidavit stating that he has not been gainfully employed.

2. The learned Additional Government Pleader representing the respondent submitted that if the petitioner is gainfully employed, he shall be required to return the amount.

In view of the above submissions, this petition is allowed and the respondent is directed to pay the last drawn wages under Section 17B of the Industrial Disputes Act and that the arrears are ordered to be paid within a period of six weeks from the date of receipt of copy of this order. If the petitioner is gainfully employed, he is bound to return the amount paid by the respondent.
