ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 1st respondent to hear the application submitted by the petitioner on 16.05.2024 under Section 3 G (5) of the National Highways Act, 1956 and to pass orders within the time frame fixed by this Court.

Heard P.Gunaraj, learned counsel for the petitioner and Mr.M.R.Gokul Krishnan, learned Additional Government Pleader for respondents 1 and 2 and Mrs.S.R.Sumathy, learned Standing counsel for 3rd respondent.

The learned Additional Government Pleader on instructions submitted that the petition filed by the petitioner under Section 3 G (5) of the Act is pending before the 1st respondent.

Taking into consideration the facts and circumstances of the case and the considering the materials placed before this Court, there shall be a direction to the 1st respondent to deal with the petition filed by the petitioner under Section 3 G (5) of the Act dated 16.05.2024 on its own merits and in accordance with law after affording opportunity to the National Highways Authority of India and final orders shall be passed with a period of 12 weeks from the date of receipt of a copy of this order. 5.

This writ petition is disposed of with the above directions. No costs.
