ORDER
The present Criminal Original Petition is filed to direct the respondents 1 to 3 to give police protection to the petitioner's life and liberty by considering
the petitioner's complaint dated 22.02.2026.

The case of the petitioner is that he is having agricultural land to the extent of four acres in Survey Nos.120/2, 118/1, 106/A1 and 106/B2 situate at Villupuram Village and Taluk. His father had been cultivating the land till his life time ie., upto the year 1985. Thereafter, the petitioner has been cultivating the land without any hindrance from any quarters. However, some unscrupulous persons disturbed his peaceful possession and enjoyment of the property which prompted the petitioner to file civil suit in O.S.No.25 of 2007 before the learned Principal Subordinate Court, Villupuram. The learned Principal Subordinate Court, Villupuram, vide judgment dated 11.06.2008 granted injunction restraining the defendants from interfering with the peaceful possession of the plaintiff/petitioner herein.
Thereafter, as there was further disturbance by the Villupuram Municipality, the petitioner filed another suit in O.S.No.67 of 2020 before the learned Principal District Munsif, Villupuram wherein the Commissioner of Villupuram Municipality was restrained from interfering with the peaceful possession and enjoyment of the property in question vide judgment dated 24.03.2021. While so, the second respondent/Deputy Superintendent of Police is supporting the private respondents and threatening the petitioner to vacate the land despite the petitioner obtaining civil court jugments in his favour. Therefore, the petitioner has given a complaint on 22.02.2026.

The learned counsel appearing for the sixth respondent submitted that there is no agricultural activities in the land in question as alleged by the petitioner instead the land was laid out by obtaining DTCP approval and the petitioner by suppressing the truth had given a false complaint. The petitioner has not produced all the civil court judgments completely. 4.
The learned Additional Public Prosecutor appearing for the respondents 1 to 3 submitted that on the complaint of the petitioner, CSR No.138 of 2026 has been assigned on 25.02.2026 and both the petitioner and the contesting respondents shall appear before the third respondent police and make their claim and counter claim along with their supporting documents. 5.
Heard the learned counsel on either side and perused the documents available on record.

Considering the submission of both sides, it is seen that the petitioner had lodged a complaint with the third respondent on 22.02.2026 in which CSR No.138 of 2026 was assigned on 25.02.2026 and thereafter, no enquiry has been conducted. Now, the learned counsel for the petitioner and the learned counsel for the sixth respondent agreed that both the parties will appear
before the third respondent. Therefore, the petitioner and the sixth respondent are directed to appear before the third respondent police along with relevant documents and give explanation. On appearance of the petitioner and the sixth respondent, the third respondent shall complete the enquiry within a period of two weeks thereafter and take appropriate action accordingly. 7.
With the above direction, this Criminal Original Petition is disposed of.
