... Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing first respondent to dispose of petitioner's representation dated 14.03.2020.
For Petitioner : Mr.V.Balamurugan For Respondents: Mr.V.S.Shanmuga Sundar
ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing first respondent to dispose of petitioner's representation dated 14.03.2020.
2. Heard learned counsel for petitioner and learned counsel appearing for respondents.
3. Learned counsel for petitioner submits that petitioner is the resident of Ekkatampalayam Village. Petitioner's wife was assigned a house site by proceedings of second respondent dated 18.02.2014. They have constructed a residential house and has
been residing there. On the western side of the property, there is a vacant land in which a Vinayagar temple was constructed adjoining the approach road/public passage stated in the assignment deed. Since the temple was in a dilapidated condition, the temple was shifted to the south side of the approach road/public passage. It is pertinent to note that water connection to various residents have been provided through the approach road/public passage apart from a public water connection. Further, electric lines are also going through the said approach road/public passage providing street lights and electric connection to the residents of the locality. The grievance of the petitioner is that a proposal is made to construct a compound wall around the temple blocking the approach road/public passage.
If the compound wall is erected around the temple, it will cause hindrance and prejudice to the petitioner and other residents. In this regard, petitioner has submitted a detailed representation to the respondents herein. Since no action was taken, the present petition has been filed seeking the aforesaid relief.
4. Considering the said submission, this Court, without going into the merits of the case, directs respondents herein to dispose of the petitioner's representation dated 14.03.2020 on merits and in accordance with law within a period of eight weeks from the date of receipt of this order.
The Writ Petition is disposed of with the above direction. No costs.
