Seeking leave to sue respondents 1 and 2, the applicant/plaintiff has come up with this application.

2.Applicant is the plaintiff in the suit filed for recovery of money on mortgage. Learned counsel for the applicant submits that the entire transaction has taken place within the territorial jurisdiction of this Court and execution of the promissory note has also taken place wthin the territorial jurisdiction of this Court. Leave is sought for only on the ground that respondents 1 and 2 are residing outside the territorial jurisdiction of this Court.

3.Considering the submissions made by the learned counsel for the applicant and also considering the averments made in the plaint, leave is granted.
