ORDER

This is a petition filed by the petitioner seeking to quash the proceedings of the first respondent and to direct the first respondent to issue the renewal passport in favour of the petitioner within a time frame.

2. Heard the learned counsel for the petitioner and the learned Central Government Standing Counsel accepting notice for the first respondent. Considering the limited nature of the direction this Court proposes to issue, the writ petition is taken up for final disposal without ordering notice to the second respondent.

3. The case of the petitioner is as follows:

The petitioner was holding a valid Indian passport. The passport of the petitioner expired even in the year 2022. The petitioner applied for renewal of the passport on 26.12.2022. However, the passport was not renewed and the petitioner came to know the adverse remark. Pursuant to that, the petitioner approached the first respondent on several occasions by giving detailed explanation. However, to his shock and surprise, the application of the petitioner for renewal of his passport was closed by the impugned proceedings. Hence the writ petition.

4. The Central Government Standing Counsel appearing for the first respondent submitted that the request of the petitioner would be considered if he files a fresh application.

5. In the light of the above, the writ petition is disposed of with a direction to the petitioner to apply afresh to the first respondent for a new passport within a period of two weeks from the date of receipt of a copy

of this order. On receipt of such application, the first respondent shall consider the same on merits and pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of such application in terms of the judgment passed by Hon'ble First Bench of this Court in WA.No.902 of 2023 dated 02.06.2023. No costs. Consequently, the connected WMP is closed.
