2 SATHISH [ PETITIONER CRL.MP.NO.4944/2022 IN CRL.OP.NO.1950/2022] Petitions praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i)Cancel the bail granted to the 2nd respondent in Crl.OP. No.1950 of 2022 dated on 02.02.2022 by this Honble Court and thus render justice. [CRL.MP.NO.4944/2022 IN CRL.OP.NO.1950/2022] (ii)Relex the condition, petitioner is directed to report before the respondent police on every wednesday at 10.30 a.m. until further orders as imposed on him by this Hon'ble Court in CRL.OP.NO.1950/2022 dated 02/02/2022 and thus render justice. [CRL.MP.NO.4945/2022 IN CRL.OP.NO.1950/2022] Order : These petitions coming on for orders upon perusing the petitions and the filed in support thereof and upon hearing the arguments of M/S.P.MUTHAMIZHSELVAKUMAR, Advocate for the petitioner [CRL.MP.NO.4944/2022 IN CRL.OP.NO.1950/2022] and of
M/S.J.RAMKUMAR.Advocate for petitioner [CRL.MP.NO.4945/2022 IN CRL.OP.NO.1950/2022]and of MR.R.KISHORE KUMAR, Govt. Advocate ( Crl. Side) on behalf of the 1st Respondent [IN BOTH PETITIONS]and of MR.J.RAMKUMAR,Advocate for 2nd Respondent [CRL.MP.NO.4944/2022 IN CRL.OP.NO.1950/2022] the court made the following order:- These petitions have been filed to cancel the bail granted to the 2nd respondent and to relax the condition that the petitioner shall report before the respondent police on every Wednesday at 10.30 a.m. until further orders imposed by this Court in Crl.O.P.No.1950 of 2022 dated 02.02.2022.
2. The learned Government Advocate (Crl. Side) submitted that the charge sheet was filed and the case is ripe for trial.
3. The learned counsel appearing for petitioner submitted that the 2nd respondent, being the police, attempting to tamper the witness.
4. Considering the fact that the petitioner is aged about 27 years and based upon her complaint only, the F.I.R. was registered and final report was also filed and also considering the fact that now, the 2nd respondent was suspended from service, no further adjudication is required in the petition to cancel the bail and the condition imposed on the petitioner in Cr.O.P.No.1950 of 2022 dated 02.02.2022 is relaxed and she shall report before the trial court on every Wednesday at 10.30 a.m. regularly until further orders.
5. With the above directions, the Criminal Miscellaneous Petition No.4944 of 2022 is closed and the Criminal Miscellaneous Petition No. 4945 of 2022 is ordered. Accordingly, the trial court shall dispose of the case within a period of four months from the date of receipt of copy of this order.
