Mr.S.Saishankar, learned Counsel on record for the petitioner, Mr.S.Krishnasamy, learned Counsel on record for the 1st respondent and Mr.A.Malath Devapriyam, learned Counsel on record for respondents 11 to 13 are before this Court.

2. This Court has perused the affidavit filed along with this petition. The 8th respondent namely Mr.Devanandam @ Durai died on 03.10.2023 leaving behind respondent Nos.11 to 13 as his legal heirs. On being satisfied with the reasons stated in the aforestated affidavit and also considering the submissions on either side, this Court is inclined to 2/4

allow this civil miscellaneous petition. Accordingly, this civil miscellaneous petition is allowed. No costs.

3. List the Appeal suit on 11.08.2025.
