With the consent of the parties, the writ petition is taken up for final disposal at the admission stage itself.
2. The writ petition has been filed seeking a direction to the fourth respondent to consider the petitioner's representation dated 03.02.2021.
3. According to the petitioner, he is a Class-1 contractor under the respondents. The fourth respondent announced the tender for repairing old building or renovating the School, Bridge, Government Office etc. within the district of Namakkal. Unfortunately, the fourth respondent has failed to notify the tender notification in their notice board or the regional newspapers. It is submitted that as per the procedure contemplated under the Tamil Nadu Transparency in Tenders Act, 1998 and Tamil Nadu Transparency in Tenders Rules, 2000, the Tender Notification should be notified transparently. But the fourth respondent did not affix any tender notice in their office board. Hence, the petitioner has sent a representation dated 03.02.2021 to the fourth respondent in this regard. But till date, there is no response from the fourth respondent. Hence, this petition.
4. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
5. The learned Additional Government Pleader, who takes notice on behalf the respondents, has submitted that it is only in the stage of fund allotment and the tender has not yet been issued and once the tender is floated, it will be affixed in the notice board as required under the Tamil Nadu Transparency in Tenders Act, 1998 and Tamil Nadu Transparency in Tenders Rules, 2000.
6. Recording the above said submission, the writ petition is disposed of. No costs.
