This revision is filed to direct the Subordinate Judge, Vellore to expeditiously hear and dispose O.S.No.146 of 2010 alongwith the pending applications, within a time frame.
2. The case of the petitioner is that the suit was filed in the year 2008 before the Principal District Court, Vellore for partition and permanent injunction. Subsequently, on 05.07.2010, the suit has been transferred to Sub Court, Vellore and renumbered as O.S.No.146 of 2010. Pending the suit, the defendants alienated the property. Thereafter, the plaintiffs filed two applications, one to implead the purchaser and another one to amend the plaint. Both the applications were allowed. Thereafter, the defendants filed two applications, one to re-open I.A No.419 of 2010 for further argument and the other to set aside the exparte order dated 17.03.2010. Both the applications are pending. Hence, this revision.
3. Heard Mr.K.Bijay Sundar, learned counsel for the petitioner and perused the records. Despite service of notice, the respondents have not chosen to appear before this court and there is no representation for them.
4. In view of the facts of the case and the submissions of the learned counsel for the petitioner, the learned Subordinate Judge, Vellore is directed to dispose of the applications and O.S.No.146 of
2010, as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order.
5. In the result, the Civil Revision Petition is allowed. No costs.
