Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the concerned records from the first respondent, quash the order of the first respondent dated 9.12.2010 bearing G.O.(D) No.634, Labour and Employment (A2) Department, in so far as declining to refer the dispute item No.2 relating to payment of Rs.5,000/- to the members of the petitioner-Union as given to non-members of the Union as illegal, arbitrary, contrary to law and consequently, direct the first respondent to refer the issue with regard to payment of Rs.5,000/- to the members of the petitioner-Union as given to non-members of the Union for adjudication before competent Industrial Adjudicator.

ORDER

The learned counsel for the respondents 1 and 2, brought to the notice of this Court that during the pendency of the writ petition, fresh settlement has been entered into between the management and the workmen. In view of the settlement entered into between the parties, no further adjudication needs to be undertaken in respect of the grounds raised in this writ petition. Accordingly, the writ petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also closed.
