(Order of the court was made by the Hon'ble Chief Justice) This is an application for condonation of delay of 363 in filing the appeal.

2. We have heard learned Additional Advocate General for the applicants and learned counsel for the non-applicant.

3. The application for condonation delay is opposed by learned counsel for the non-applicant on the ground that no sufficient cause is mentioned. No proper explanation has been given for the inordinate delay caused in filing the appeal. The applicants cannot claim to possess a separate period of limitation. The delay cannot be mechanically condoned only because the applicants are a wing of the Government.

4. We have considered the reasons given in the accompanying affidavit filed along with the application. The reason for delay is mentioned as time spent in getting opinion from the Legal Department. The official procedure has taken time. Moreover, the applicants were not to gain by the delay.

5. For the reasons stated in the accompanying affidavit, the delay of 363 days in filing the appeal is condoned. The application is allowed and disposed of.
