JUDGMENT

This Second Appeal has been filed to set aside the order made in A.S.No.88 of 2011 dated 27.09.2012 on the file of the Second Additional Subordinate Judge, Coimbatore by confirming the Judgment and decree made in O.S.No.165 of 2005 dated 31.01.2011 on the file of the Court of the learned District Munsif, Coimbatore.

2. The learned Counsel for the Appellant filed a memo reporting that the subject matter of the Second Appeal had been settled amicably before the trial Court. The memo is to be recorded as the Second Appeal is arising out of the Suit for recovery of money.

3. In view of the submission of the learned Counsel for the Appellant, the memo is recorded and the Second Appeal is dismissed as settled between the parties. The Appellant is entitled to refund of the Court-fee. Consequently, connected Miscellaneous Petition is closed. No costs.
