ORDER : The Court Made the following order :- The petitioner herein is the 2nd accused in a case registered by the respondent in Crime No.50 of 2022 for the alleged offences under Section 392 of IPC.
2. The petitioner herein is one among the eight accused involved in robbery of Rs.3,00,000/- from the defacto complainant. While one of the accused is still absconding, few were granted bail by the Court below quoting that, this petitioner seeks parity and claims bail.
3. However the learned Additional Public Prosecutor opposed to grant bail to the petitioner stating that this petitioner is facing 13 previous cases of similar nature and if he is released on bail, he will also abscond like other accused after obtaining bail and not report before the Investigating Officer, which is a condition imposed by the Court while granting bail. that the Investigating Officer is unable to arrest the absconding accused and secure the other accused, who have breached the bail condition.
4. Considering the inability of the Investigating Officer that if the petitioner is released on bail, he will not be able to secure the person if he absconds, hence this Court is not inclined to grant bail to the petitioner and the same is dismissed accordingly. -sd/- 05/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
