"directing the respondents to disburse the belated payment of

interest amount of CPS amount (Contributory pension Scheme), Gratuity and Earned Leave Salary amounts and other unsettle benefits of 10 days last month salary with effect from 01.06.2024 within the stipulated time".

W.P.No.9540 of 2026:

"directing the respondents to disburse the belated payment of interest amount of CPS amount (Contributory pension Scheme), Gratuity and Earned Leave Salary amounts and other unsettle benefits of 10 days last month salary with effect from 01.03.2024 within the stipulated time".

W.P.No.9533 of 2026:

"directing the respondents to disburse the belated payment of interest amount of Provident Fund, Gratuity and Earned Leave salary amounts and other unsettle benefits of E.L. Surrender of the year of 2009-2011 and 2017-2018 Difference amount of Gratuity, Earned Leave salary and pension Arrears as per 12 (3) age Settlement and 10 days last month salary with effect form 01.04.2020 within the stipulated time".

W.P.No.9544 of 2026:

"directing the respondents to disburse the belated payment of interest amount of Provident Fund, Gratuity and Earned leave salary amounts and other unsettle benefits of Difference amount of Gratuity, Earned leave salary and Pension arrears as per 12

(3) wage settlement and 10 days last month salary with effect from 1.07.2024 within the stipulated time".

W.P.No.9529 of 2026:

" directing the respondents to disburse the belated payment of interest amount of Provident, Fund Gratuity and Earned Leave

salary amounts and other unsettle benefits of Difference amount of Gratuity, Earned Leave Salary and Pension Arrears as per 12

(3) Wage Settlement and 10 days last month salary with effect from 01.06.2024 within the stipulated time".

2. The brief facts which are culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that the petitioners in W.P.Nos.9525, 9540, 9533, 9544 and 9529 of 2026 joined as Conductor, Conductor, Driver, Helper, Technical Assistant respectively, in the respondent corporation and retired from service on attaining superannuation. The respondent settled the terminal benefits with a delay.

2.2.Therefore, the respondents are legally bound to pay interest to the petitioner. Therefore, the petitioner made a representation to the respondents to pay the interest for the belated payment of the petitioners' terminal benefits and also to settle the other unsettled benefits and difference amount in their terminal benefits. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the terminal benefits has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the writ petitions are allowed in the following terms: (a) W.P.Nos.9525 and 9540 of 2026 are allowed as prayed for and a mandamus is issued directing the respondent to disburse the 6% interest for belated payment of terminal benefits and other unsettled benefits of 10 days last months salary with effect from 01.06.2024 and 01.03.2024 respectively within a period of one (1) month from the date of receipt of a copy of this order. (b) W.P.No.9533 of 2026 is allowed as prayed for and a mandamus is issued directing the respondent to disburse the 6% interest for belated payment of terminal benefits and other unsettled benefits of E.L.Surrender of the year 2009-2011 and 2017-2018 difference amount of terminal benefits, arrears as per 12(3) wage settlement and 10 days last month salary with effect from 01.04.2020 within a period of one (1) month from the date of receipt of a copy of this order.

(c) W.P.Nos.9544 and 9529 of 2026 are allowed as prayed for and a mandamus is issued directing the respondent to disburse the 6% interest for belated payment of terminal benefits and other unsettled benefits of difference amount of terminal benefits, arrears as per 12(3) wage settlement and 10 days

last month salary with effect from 01.07.2024 and 01.06.2024 respectively within a period of one (1) month from the date of receipt of a copy of this order. (d) There shall be no order as to costs.
