ORDER
The petitioner, who apprehends arrest for the alleged offence under Sections 303(2) of BNS Act [Corresponding Section 379 of IPC] in Crime No.76 of 2025, on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner along with other accused was involved in the theft of copper wire from the EB 1/4
transformer, worth about Rs.1,50,000/-. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the defacto complainant and only based on the confession statement of other accused, the petitioner has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that this is the second anticipatory bail application and that the earlier application has been dismissed by this Court and the present petition has been filed without any change in circumstances. Hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Heard the submissions made by the learned counsel on either side and also perused the materials available on record.
6. Since there is no change in circumstances for the present anticipatory 2/4
bail application, the nature of offence is also theft of EB copper wire and so far, no recovery has been effected, this Court is not inclined to enlarge the petitioner on anticipatory bail.
