This Criminal Original Petition has been filed by the petitioners, who are arrayed as A2 and A3 in Spl.C.C.No.5 of 2014 (RC.No.9(A)/2013 of CBI/ACB, Chennai). The petitioners have filed this petition in RC.MA.1 2013.A.0009 pending on the file of Principal Special Judge for CBI Cases, Puducherry and quash the final report as against the petitioners. The Principal Special Judge for CBI Cases, Puducherry has taken charge sheet on file in Spl.C.C.No.5 of 2014.

2. Today, when the matter is taken up for consideration, there is no representation for the petitioners.

The learned Special Public Prosecutor appearing for the respondent would submit that the charges are framed against the accused and prosecution evidence is also commenced. So far PW1 to PW5 have been examined and the case is posted on 09.08.2017 before the trial court for the examination of PW6. Therefore, it is understood that these petitioners actively participated in the trial.

4. Once charge sheet was taken on file and Special Criminal Case number was also allotted and charges were framed against the petitioners others trial has been commenced, nothing

survives for adjudication in this petition. Therefore, this petition is liable to be dismissed and accordingly the same is dismissed. In the result, this Criminal Original petition is dismissed.
