This petition is filed to restore the Crl.O.P.No.29312 of 2017, which was dismissed for non-prosecution on 05.01.2022.
2. The learned counsel for the petitioner submitted that on 05.01.2022 the case was listed by virtual mode and there was some connectivity problem, further he was also not conversant with the procedure, due to which he was unable to get connected to make representation. He further submitted that he is ready to argue the main case on the next hearing date on the appearance of the respondent. It is a private complaint case.
3. Accepting the reasons assigned in the affidavit filed in support of the petition and in view of the fact that the non-appearance was due to technical constraints during the virtual hearing, this petition is ordered and Crl.O.P.No.29312 of 2017 is restored.

4. The petitioner is directed to take notice to the respondent returnable by 10.06.2022. Private notice is also permitted. So that the main Crl.O.P. can be heard.
5. Post on 10.06.2022. The status quo as on 05.01.2022 shall be maintained till then.
